American Family Association and National Religious Broadcasters petition against FCC rule on gender requirements

TUPELO, Miss. — Last Friday, American Family Association (AFA, www.AFA.net) and National Religious Broadcasters (NRB) association filed a petition for review of the Federal Communications Commission rule (FCC 24-18). This would reinstate Form 395-B after 20 years of suspension and force broadcast stations to report annual information on their employees’ race, ethnicity and gender. The two organizations said the rule goes beyond the FCC’s “statutory authority, violates the equal protection component of the Fifth Amendment and the Free Speech Clause of the Fifth Amendment, and is an abuse of the FCC’s discretion.”

“Shortly after announcing their unconstitutional attempt to rewrite Title IX and welcome men to intrude upon and even replace women, they’ve now expanded their initiative to attempt to compel broadcasters to embrace their regressive gender identity ideation via FCC regulation,” says AFA General Counsel and Public Policy Analyst Abe Hamilton. “A version of this effort was required by the FCC in the 1980s and 1990s but was discontinued after courts ruled that it placed an undue regulatory burden on broadcasters, in violation of the Constitution. The courts will once again have to remind the Biden administration that they are not above the law. As a result, we have filed a lawsuit to halt this unconstitutional abuse of power by the federal government and we expect to prevail.”
