Tell Sen. Graham to Halt Democrats’ Attacks Against Judge Barrett’s Faith

Judge Amy Coney Barrett is President Trump’s Supreme Court nominee to fill the vacancy on the court left by Justice Ruth Bader Ginsburg. Judge Barrett is scheduled to go before the Senate Judiciary Committee for a hearing during the week of October 12. This is the same committee Judge Barrett went before in 2017 when her religious faith came under attack, and Senator Lindsay Graham (R-SC) is the chairman of this committee.

Sign the petition to Senate Judiciary Chairman Lindsay Graham urging him to immediately rule out of order any attack against Judge Barrett's religious faith.

Three years ago, Senator Dick Durbin (D-IL) and Senator Diane Feinstein (D-CA) attacked Judge Barrett's religious faith during her Senate Judiciary Committee hearing. Judge Barrett was being considered as President Trump's nominee to the U.S. Court of Appeals for the Seventh Circuit.

Judge Barrett was ultimately confirmed by the Senate, but during that hearing, Senator Durbin asked Judge Barrett, "Do you consider yourself an orthodox Catholic?" Senator Feinstein later blatantly attacked Judge Barrett's religious faith. Senator Feinstein said:

Why is it that so many of us on this side have this very uncomfortable feeling that, you know, dogma and law are two different things, and I think whatever religion is, it has its own dogma. The law is totally different, and I think in your case, professor, when I read your speeches, the conclusion one draws is that the dogma lives loudly within you.

It is unconstitutional for senators to raise questions about a judicial nominee's religious faith or to raise questions about the nominee's practice of her constitutionally-protected freedom of religious expression.

Article VI of the U.S. Constitution states, "no religious test shall ever be required as a qualification to any office or public trust under the United States." Senator Durbin and Senator Feinstein violated the U.S. Constitution by using Judge Barrett's faith as a qualifying test during the Judiciary Committee hearing.

Senate Judiciary Chairman Lindsay Graham will be the presiding officer over Judge Barrett's Supreme Court hearing. Sign the petition to urge Senator Graham to immediately rule out of order any attack against Judge Barrett's religious faith.
